1. Purpose
This Damage & Liability Agreement (“Agreement”) forms part of the hire contract between Earhart Events (t/a Earhart Group Ltd) (“the Company”) and the Client (“the Hirer”).
It outlines the responsibilities and liabilities of the Client regarding the care, condition, and return of hired items and equipment during the hire period.
2. Responsibility During Hire Period
All hired items remain the property of Earhart Events (t/a Earhart Group Ltd) at all times.
The Client is fully responsible for all items from the time of delivery/collection until the time they are collected or returned by the Company.
The Client agrees to handle all items with reasonable care and ensure they are used only for their intended purpose.
The Client shall not lend, sub-hire, alter, or move any items from the agreed location without prior written consent from the Company.
3. Damage, Loss, or Theft
The Client agrees to be liable for any loss, damage, breakage, or theft of any item during the hire period, regardless of cause, including but not limited to:
Accidental damage
Fire, weather, or water damage
Misuse, neglect, or improper handling
Theft, loss, or disappearance
Charges
Replacement Value: The Client agrees to pay the full replacement cost for any lost or irreparably damaged items.
Repair or Cleaning Fees: If items are returned dirty, stained, or damaged, reasonable repair or cleaning fees will apply.
Security Deposit: A refundable security deposit may be required prior to delivery. Deductions may be made for damage, loss, or late returns.
4. Setup and Safety
Where setup is performed by the Company, items will be placed safely and securely.
Once setup is complete, the Client assumes responsibility for ensuring items remain undisturbed and safe from damage or interference.
The Client is responsible for ensuring adequate supervision during the event, particularly around children, guests, or pets near hired items.
Electrical items must not be tampered with, moved, or used outdoors unless specified as suitable for such use.
5. Public Liability
Earhart Events maintains appropriate Public Liability Insurance for its operations.
However, the Client accepts full responsibility for any injury, loss, or damage caused by misuse, mishandling, or unauthorised use of equipment while in their possession.
The Company shall not be held liable for any indirect, consequential, or incidental losses arising from use of the hired items.
6. Force Majeure
The Company shall not be liable for failure to deliver or collect items due to circumstances beyond its reasonable control, including adverse weather, accidents, traffic delays, illness, or government restrictions. In such cases, the Company will make all reasonable efforts to provide an alternative or reschedule where possible.
7. Acknowledgement
The Client acknowledges that:
They have read, understood, and agree to abide by this Damage & Liability Agreement.
They have also read and agreed to the Terms & Conditions, Returns & Refunds Policy, and Privacy Policy of Earhart Events.
They accept full financial responsibility for any damage, loss, or breach of these terms.
